CONTEST RULES – GO FOR BOLD

1.      Death Wish Coffee Co. (“Death Wish”) invites you to submit photo and/or video content for a chance to have your content used by Death Wish.  If you submit content to Death Wish in connection with this contest, you agree to be bound by these Contest Rules.

2.      Prizes

a.      Prize packages will be awarded to the top entries as follows.

                                                    i.     1 Photo Grand Prize Winner will receive a Trip to Saratoga Springs, New York:

1.      Pick two nights to travel to Saratoga Springs, NY to see the home of the World’s Strongest Coffee

2.      Includes dinner with members of the DWC team

3.      A tour of our office and production facility

4.      $250 gift card to shop in our retail space

5.      Hotel and travel paid for by DWC

6.      Redeemable for up to a year after winning (dates to be mutually agreed upon by winner and DWC team).

7.      An exclusive mug from DWC

                                                   ii.     50 Photo Winners Will Be Awarded A Gift Card Worth $100

                                                  iii.     1 Video Grand Prize Winner will receive $5,000 To Fuel Their Next Bold Adventure and an exclusive mug from DWC

                                                  iv.     10 Video Winners Will Be Awarded A Gift Card Worth $500

3.      Photos or videos submitted must be in high resolution, and videos must be no longer than 30 seconds and saved as an .mp4.  Failure to follow these guidelines risks disqualification.

4.      Submissions will be accepted online beginning on May 13, 2021.  You may enter as many times as you wish.  The deadline for entry is 11:59 pm EST on June 6, 2021. All winners will be selected by Death Wish, as determined in Death Wish’s sole discretion. Winners will be notified on June 13, 2021.  Death Wish reserves the right, to be exercised in Death Wish’s sole discretion, to reject or disqualify any entries if Death Wish has reason to believe that they reflect efforts by anyone to unfairly or improperly manipulate the outcome of the contest.

5.      We do encourage you to consider the suitability of what you submit for use by Death Wish. Death Wish reserves the right, to be exercised in Death Wish’s sole discretion, to reject or disqualify any photo or video submitted.

6.      Eligibility: Entrants must be age 18 or older at the time of entry

7.      No Purchase Necessary to Enter or Win: You do not need to make a purchase to enter or win this contest. A purchase will not increase your chances of winning.

8.      Void Where Prohibited by Law

9.      Any disputes arising under these Contest Rules will be governed by the laws of the State of New York without reference to its conflict of laws provisions.  Any disputes arising under these Contest Rules must be brought exclusively in the courts located in New York, and the parties submit to the exclusive jurisdiction of those courts.

10.   The content you submit must be original to you, and not copied from someone or somewhere else.  No unauthorized use of any copyright images, text, or other material will be accepted.

11.   All entries must be submitted online.  Go to deathwishcoffee.com/goforbold and follow the instructions on the simple submission form or submit on Instagram by tagging @deathwishcoffee and using the hashtag #GoForBold in your post.

12.   Technical Difficulties/Support: Death Wish cannot be responsible for entries not received due to technical issues and accepts no responsibility for technical support of any entries.

13.   Guidelines & Judging Criteria

a.      Content should be appropriate for use by Death Wish.

b.      Winners will be selected by an internal committee, in its sole and exclusive discretion

14.   Ownership of Artwork: To the extent permitted by law, all submissions of content to Death Wish consisting of copyrightable subject matter are "work made for hire" as defined in the Copyright Act of 1976 (17 U.S.C. § 101), and such copyrights are therefore owned by Death Wish. To the extent that the foregoing does not apply, by submitting your content to Death Wish, you hereby irrevocably assigns to Death Wish, and its successors and assigns, for no additional consideration, your entire right, title, and interest in and to all such artwork and intellectual property rights therein, including without limitation the right to sue, counterclaim, and recover for all past, present, and future infringement, misappropriation, or dilution thereof, and all rights corresponding thereto throughout the world. Nothing contained in these Contest Rules shall be construed to reduce or limit Death Wish’s right, title, or interest in any content or intellectual property rights so as to be less in any respect than Death Wish would have had in the absence of these Contest Rules.

15.   Authorize Rights to Death Wish: By submitting your photo and/or video, you authorize Death Wish to post your entry on our site and social media channels indefinitely, and grant Death Wish the right to use and display your design for marketing purposes through any or all of Death Wish’s marketing channels. This includes but is not limited to print publications, online, on social media, in advertising, and in emails.

16.   Your selection as a winner does not obligate Death Wish to use your content.

17.   Death Wish reserves the right, to be exercised in Death Wish’s sole discretion, to adjust contest rules without notifying contestants.

18.   Contest rules can be changed and updated without notice. Contest participants are responsible for checking the site for changes, and should review the rules prior to each submission.
