PLEASE READ THESE TERMS AND CONDITIONS OF PARTICIPATION IN THE RITUAL REWARDS PROGRAM CAREFULLY. BY PARTICIPATING IN THIS PROGRAM, YOU AGREE TO BE BOUND BY THE TERMS DESCRIBED HEREIN AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT PARTICIPATE IN THIS PROGRAM.
THESE TERMS AND CONDITIONS MAY BE MODIFIED FROM TIME TO TIME. ANY MODIFICATIONS TO THESE TERMS AND CONDITIONS WILL BE POSTED ON THIS WEB PAGE. YOUR CONTINUED PARTICIPATION IN THE PROGRAM AFTER AMENDMENT OF THESE TERMS AND CONDITIONS WILL BE DEEMED TO BE YOUR CONSENT TO CONTINUE TO PARTICIPATE IN THE PROGRAM. WE URGE YOU TO CHECK THESE TERMS AND CONDITIONS FOR TIME TO TIME SO YOU CAN BE AWARE OF ANY UPDATES.
The Death Wish Coffee, LLC (“Death Wish Coffee”) Ritual Rewards Program (the “Program”) is designed to help you get the most out of your membership. We are thrilled that you shop at https://www.deathwishcoffee.com/ (the “Site”), refer friends our way, and send us feedback on your experience being a Death Wish Coffee customer.
The following terms and conditions (these “Program Terms and Conditions”) contain important information regarding the Program. Please read the following Program Terms and Conditions carefully. These Program Terms and Conditions are a binding agreement between you and Death Wish Coffee and will govern your participation in any and all Program offers.
By joining the Program and becoming a Program member, you (individually and collectively, “you,” “your,” or “Member”), agree that you have read, understood and agree to be bound by these Program Terms and Conditions and by any changes or modifications we may make. You should review these Program Terms and Conditions and the related policies and FAQs frequently to understand the terms and conditions that apply to the Program as they may change from time to time. These Program Terms and Conditions do not alter in any way the terms or conditions of any other agreement you may have with us, including any agreement for products or services. By enrolling in the Program, you also agree to be bound by our website Privacy Policy and our website Terms and Conditions, which are incorporated herein by reference. If you do not agree to these Program Terms and Conditions, our website Privacy Policy, and our website Terms and Conditions, you cannot participate in the Program. The Program is void where prohibited by law.
Upon notice, Death Wish Coffee may, in its sole and absolute discretion, cancel, change, suspend or modify any aspect of the Program or any Program Reward at any time, including the availability of any Program Reward.
- Program Period
This Program will continue until terminated, suspended, modified, or converted to another rewards program by Death Wish Coffee (the ”Program Period”).
- Enrollment in Program
Eligible individuals may enroll in the Program by visiting the Site and following the Program prompts to register for the Program. You do not need to have a subscription to earn Points in the Program. You are required to provide your email address in order to enroll in the Program. You will also need to create an account by providing your name and creating a password in order to access certain Program benefits and rewards. You are solely responsible for maintaining the accuracy of your account information and for updating it as required. You may update your personal information on the Site. Only one Program account may be associated with a single email address. In the event of a dispute over ownership of the Program membership account, the member will be deemed to be the authorized account holder of the email address submitted at the time of enrollment. For purposes of these Program Terms and Conditions, the "authorized account holder" is the natural person who is assigned to the submitted email address by an internet provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Although providing your birthday is not required in order to participate in the Program, in order to receive the birthday reward, you must provide your birthday (day and month only) in your account.
- How the Program Works; Earning Death Wish Coffee Points
The Program is a way in which we reward and thank our loyal customers for purchasing our products and for participating in certain brand experiences on the Site. You are able to earn points (“Points”) and reach Program loyalty tiers by making eligible purchases or taking certain other Program actions. Once you earn Points and reach a certain tier, you may be eligible for certain benefits and rewards applicable to that tier, which benefits may change from time to time and may be offered on a limited basis. Eligible purchases and other opportunities to earn points and reach Program tiers will be posted on the Site or may be published through other media (e.g., in marketing communications, social media, etc.).
The Program is a tier-based program determined by the number of points a member has earned within a single year on eligible purchases and through qualifying activities, beginning on the date when you enroll. There are 3 tiers with associated benefits:
Tier 1: 0-600 Points - Members receive 1 point for every $1 spent
Tier 2: 601 – 1000 Points - Members receive 3 points for every $1 spent
Tier 3: 1001+ Points - Members receive 5 points for every $1 spent
You can begin earning Points by taking certain actions. How you can earn Points and what type of rewards you receive are described on Exhibit 1 below. Upon notice, Death Wish Coffee reserves the right to suspend, terminate, revalue or modify, without liability to Members, all or part of the Points’ value structure and offers and any merchandise or service. Death Wish Coffee reserves the right to adjudicate all Points discrepancies in its sole discretion, and the Members agree to abide by any such adjudication. You can check your Death Wish Coffee Points balance on your account page.
- Death Wish Coffee Points Redemption
As a member, you earn Points that determine your benefits plus tier levels and tier benefits. To redeem offers and rewards, you must have accumulated the minimum number of Points as established by us for a particular benefit. Product rewards and samples are shipped with product purchases on the Site only. Points may never be exchanged for cash. You must be logged in to your Program account to use your benefits. You will find your eligible offers and rewards (with offer codes if applicable) listed in your personal account. Qualifying members will receive email invitations when event rewards are available if they have not opted-out of receiving Program emails.
Points Benefits: At different point levels you will unlock rewards that can be used in conjunction with a purchase on the Site. These are described on Exhibit 1 and may be updated and modified from time to time. You should reference the Site or the latest communication from Death Wish Coffee for the most current rewards and benefits information. All rewards are based on the number of Points you have accumulated in a single year as listed below. You must redeem your unlocked rewards prior to your anniversary date, or the available rewards will expire. On your 12 month anniversary date, your points reset to zero and you start accumulating new points and unlocking new rewards. You may only redeem one points benefit reward per order. Points benefits cannot be combined with other Site-wide promotional offers (e.g., other discounts, free sample offers, free product offers, etc.).
Offers and rewards are available while supplies last and substitutions made by us in our sole discretion may occur. If your online order is not completed for any reason, any offers or rewards will be removed from your shopping basket and may no longer be available. You are not required to redeem your accumulated rewards and/or benefits. We are unable to reship offers or rewards if they arrive damaged, if you received the wrong one or if one is missing from your order. In the event an offer or reward arrives damaged, you received the wrong one, or one is missing from your order, please contact Customer Service.
Neither accounts nor Program rewards, benefits and/or points may be transferred, shared or combined. Only the member paying for the products may accumulate rewards, benefits and/or points. We reserve the right to monitor the number of accounts per household and refuse, merge or close additional or duplicate accounts at any time. Your account information (including security details) are confidential and should not be shared with any other person.
Rewards, benefits and points earned through the Program have no cash value, are non-transferable, and you have no property rights in or to rewards or other Program benefits. Purchase balances and/or points credited to your Program account will be decreased or reversed, as applicable, if part or all of a purchase is returned or cancelled or if the credit is obtained through fraudulent or other activity that violates these Program Terms and Conditions. The sale, barter, transfer, or assignment of any rewards or benefits offered through the Program, other than by us, is expressly prohibited.
Rewards cannot be exchanged or returned for points, another product or service or a monetary refund.
The products and services available through the Program and any samples that we may provide to you are for personal use only. You may not sell or resell any of the products, services, or samples you purchase or otherwise receive from us. We reserve the right, without notice, to cancel or reduce the quantity of any order to be filled and/or any products or services to be provided to you that we believe, in our sole discretion, may result in the violation of our Program Terms and Conditions.
We are not responsible for rewards, benefits and/or points lost or redeemed due to fraudulent activity by you or any third party.
We reserve the right to change Program benefits, how you earn points and reach each Program tier and how we evaluate and reward your eligible purchases and/or other Program activity. We reserve the right to place limits on the number of purchases or activities that are eligible for the Program and/or for any given tier, the number or types of rewards or benefits you may receive or earn in any given tier, in a given time period or for the duration of the Program, and/or any combination thereof.
If you have concerns that a purchase or other activity was not properly applied to your account, you should contact Death Wish Coffee Customer Service. Your email must specify your name and email address associated with the Program, the date of the Program activity, and the issue(s) you encountered. This email must be sent no more than forty-five (45) days after the date the purchase or other Program activity took place. We are not responsible for late notifications about purchases or other Program activities not being credited to an account.
Rewards and Points can only be redeemed on the Site and only with a product purchase, unless otherwise noted by Death Wish Coffee.
- Death Wish Coffee Points Expiration
Points will expire 12 months from the date they were first earned. If Member does not redeem Points within this time frame, Member forfeits all such Points. Your Account page lists your Points balance history, which displays the dates your points were earned.
- Reward and Points Conditions
Rewards and Points may be taxable, depending on the value of the item and the federal, state, and local tax laws applicable to Member. Members are solely responsible for reporting such items on their tax returns and paying any associated tax liability.
- Program Communications
By enrolling in the Program, you will be automatically subscribed to receive and you consent to receive Death Wish Coffee marketing emails, including Program-related communications.
You may opt-out of receiving marketing emails or Program-related emails at any time by following the instructions provided in the email and as otherwise provided in the Death Wish Coffee Privacy Policy. If you opt-out of Program-related emails, you will no longer receive emails regarding your Program status or the Program rewards or benefits that may be available to you.

- Modifications to and Termination of the Program
Death Wish Coffee may, in its sole and absolute discretion, cancel, change, suspend, or modify any aspect of the Program and/or any Points at any time, including the availability of any rewards. Death Wish Coffee may, in its sole and absolute discretion, terminate or suspend any Member’s participation in the Program for breach of these Program Terms and Conditions, or for taking any actions that are inconsistent with the intent of these Program Terms and Conditions. Death Wish Coffee reserves the right at its sole discretion to prohibit any Member from participating in any aspect of the Program if Death Wish Coffee deems or suspects that such Member has engaged in or has attempted to engage in any of the following: (a) acting in violation of these Program Terms and Conditions; or (b) damaging, tampering with or corrupting the operation of the Program or Site; or (c) acting with intent to annoy, harass or abuse any other person; or (d) any inappropriate, uncooperative, disruptive, fraudulent, potentially fraudulent, or unusual behavior or activity; or (e) activity deemed in the sole discretion of Death Wish Coffee to be generally inconsistent with the intended operation of the Program. Any decision Death Wish Coffee makes relating to termination or suspension of any Member’s participation in the Program shall be final and binding in all respects. Death Wish Coffee shall be the sole determiner in cases of suspected abuse, fraud, or breach of these Program Terms and Conditions or intent of these Program Terms and Conditions.
- Disclaimer of Warranties; Limitation of Liability
NEITHER DEATH WISH COFFEE NOR OUR PARENTS, SUBSIDIARIES, AFFILIATES, PARTNERS, OR LICENSORS WILL BE RESPONSIBLE OR LIABLE IN CONTRACT, WARRANTY OR IN TORT (INCLUDING NEGLIGENCE) FOR ANY (a) INTERRUPTION OF BUSINESS; (b) ACCESS DELAYS OR ACCESS INTERRUPTIONS TO THE PROGRAM; (c) DATA NON-DELIVERY, LOSS, THEFT, MISDELIVERY, CORRUPTION, DESTRUCTION OR OTHER MODIFICATION; (d) LOSS OR DAMAGES OF ANY SORT INCURRED AS A RESULT OF DEALINGS WITH OR THE PRESENCE OF THIRD PARTY LINKS ON THE SITE OR USE OF ANY REWARD OR BENEFIT OF THE PROGRAM; (e) COMPUTER VIRUSES, SYSTEM FAILURES OR MALFUNCTIONS WHICH MAY OCCUR IN CONNECTION WITH YOUR USE OF THE SITE, INCLUDING DURING HYPERLINK TO OR FROM THIRD PARTY WEBSITES; (f) ANY INACCURACIES OR OMISSIONS IN PROGRAM CONTENT; OR (g) EVENTS BEYOND OUR REASONABLE CONTROL. WE MAKE NO REPRESENTATIONS OR WARRANTIES THAT DEFECTS OR ERRORS WILL BE CORRECTED.
YOU AGREE THAT NEITHER DEATH WISH COFFEE NOR OUR PARENTS, SUBSIDIARIES, AFFILIATES, PARTNERS, OR LICENSORS WILL BE RESPONSIBLE OR LIABLE IN CONTRACT, WARRANTY OR IN TORT (INCLUDING NEGLIGENCE) FOR ANY (a) INTERRUPTION OF BUSINESS; (b) ACCESS DELAYS OR ACCESS INTERRUPTIONS TO THE PROGRAM; (c) DATA NON-DELIVERY, LOSS, THEFT, MISDELIVERY, CORRUPTION, DESTRUCTION OR OTHER MODIFICATION; (d) LOSS OR DAMAGES OF ANY SORT INCURRED AS A RESULT OF DEALINGS WITH OR THE PRESENCE OF THIRD PARTY LINKS ON THE SITE OR USE OF ANY REWARD OR BENEFIT OF THE PROGRAM; (e) COMPUTER VIRUSES, SYSTEM FAILURES OR MALFUNCTIONS WHICH MAY OCCUR IN CONNECTION WITH YOUR USE OF THE SITE, INCLUDING DURING HYPERLINK TO OR FROM THIRD PARTY WEBSITES; (f) ANY INACCURACIES OR OMISSIONS IN PROGRAM CONTENT; OR (g) EVENTS BEYOND OUR REASONABLE CONTROL. WE MAKE NO REPRESENTATIONS OR WARRANTIES THAT DEFECTS OR ERRORS WILL BE CORRECTED.
FURTHER NEITHER DEATH WISH COFFEE NOR OUR PARENTS, SUBSIDIARIES, AFFILIATES, PARTNERS, OR LICENSORS WILL BE LIABLE FOR ANY INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING LOST PROFITS) RELATED TO THE PROGRAM OR AND YOUR PARTICIPATION THEREIN, WHETHER IN CONTRACT, WARRANTY OR IN TORT (INCLUDING NEGLIGENCE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND IN NO EVENT SHALL OUR MAXIMUM AGGREGATE LIABILITY EXCEED ONE HUNDRED DOLLARS ($100.00).
YOU AGREE THAT NO CLAIMS OR ACTION IN CONTRACT, WARRANTY OR IN TORT (INCLUDING NEGLIGENCE) ARISING OUT OF, OR RELATED TO, YOUR PARTICIPATION IN THE PROGRAM, USE OF ANY REWARDS OR OTHER BENEFIT OR THESE PROGRAM TERMS AND CONDITIONS MAY BE BROUGHT BY YOU MORE THAN ONE (1) YEAR AFTER THE CAUSE OF ACTION RELATING TO SUCH CLAIM OR ACTION AROSE. IF YOU ARE DISSATISFIED WITH THE PROGRAM, TERMINATION OF YOUR MEMBERSHIP IN THE PROGRAM IS YOUR SOLE REMEDY. WE HAVE NO OTHER OBLIGATION, LIABILITY, OR RESPONSIBILITY TO YOU.
- Indemnification
Members agree to indemnify, defend and hold Death Wish Coffee and its representatives and agents harmless from and against any and all third party claims, demands, liabilities, costs or expenses, including attorney’s fees and costs, arising from, or related to any breach by Member of any of these Program Terms and Conditions or any violation by Member of applicable law.
- Governing Law
Any dispute arising out of or in connection with these Program Terms and Conditions shall be subject to interpretation under the laws of the State of New York, without regard to choice of law principles. You agree that any such lawsuits filed in connection with these Program Terms and Conditions shall be filed exclusively in the state or federal courts located in New York County, New York. You further agree that venue in New York County, New York is both convenient and proper.
- Force Majeure
In no event shall Death Wish Coffee be liable to you for any failure or delay in performing its obligations under this Agreement when and to the extent such failure or delay is caused by any circumstances beyond such Party’s reasonable control, including but not limited to: (i) acts of God; (ii) flood, fire, earthquake, or explosion; (iii) war, invasion, hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest; (iv) government order, law, or actions; (v) embargoes or blockades in effect on or after the date of this Agreement; and (vi) national or regional emergency.
- Miscellaneous
This Agreement, together with any other documents incorporated herein by reference and all related Exhibits, constitutes the sole and entire agreement of the Parties with respect to the subject matter of this Agreement and supersedes all prior and contemporaneous understandings, agreements, and representations and warranties, both written and oral, with respect to such subject matter. No failure by Death Wish Coffee to exercise, or delay in exercising, any rights, remedy, power, or privilege arising from this Agreement will operate or be construed as a waiver thereof; nor will any single or partial exercise of any right, remedy, power, or privilege hereunder preclude any other or further exercise thereof or the exercise of any other right, remedy, power, or privilege. If any provision of these Program Terms and Conditions is deemed invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability will not affect any other term or provision of this Agreement or invalidate or render unenforceable such term or provision in any other jurisdiction.
